An over‑indebtedness procedure is a legal instrument that allows individuals, small business owners, professionals, agricultural businesses, and other non‑bankrupt entities facing serious financial difficulties (that is, no longer able to regularly repay their debts) to restructure or settle their debts in a sustainable way and within a sustainable timeframe.

Business crisis resolution tools are procedures that allow companies facing economic or financial difficulties to overcome the crisis while safeguarding business continuity as far as possible. Each tool aims to avoid immediate business closure, limit negative consequences for entrepreneurs, employees, and creditors, and facilitate a return to normal operations.

public procurement

Public procurement consulting helps businesses and professionals successfully take part in tenders issued by public entities. This includes analysing the tender notice and participation requirements, preparing and reviewing all documentation, and providing support in drafting bids. If a public entity adopts decisions that are deemed unlawful, we provide legal assistance by analysing its documents and reasoning, filing administrative appeals or requests for review, and defending our clients in proceedings before administrative courts.

La sentenza n. 3868/2026 delle Sezioni Unite della Cassazione chiarisce che le controversie relative alle procedure per il conferimento degli incarichi di direzione di struttura sanitaria complessa rientrano nella giurisdizione del giudice ordinario, in funzione di giudice del lavoro. Anche dopo le modifiche introdotte dalla legge n. 118/2022 all’art. 15, comma 7‑bis, d.lgs. 502/1992, tali incarichi non sono conferiti tramite pubblico concorso e non opera l’art. 63, comma 4, d.lgs. 165/2001.
La Corte d'Appello di Cagliari – Sezione distaccata di Sassari, con sentenza 23 febbraio 2026, n. 79, affronta il contenzioso sul conto corrente bancario affidato sotto tre profili fondamentali: nullità delle clausole su interessi, capitalizzazione e commissioni; ricostruzione del saldo in presenza di documentazione incompleta; distinzione tra versamenti ripristinatori e solutori ai fini della prescrizione. La Corte riconosce inoltre gli interessi ex art. 1284, comma 4, c.c. sull'obbligazione restitutoria da indebito bancario, inserendosi nel più recente orientamento della Cassazione.
